The free association of election integrity activists known as the US Election Integrity Plan (USEIP), two of its cofounders, and one of its volunteers were completely vindicated in Federal Court Thursday.
Ashe Epp, Colorado Free Press Editor and a defendant in the case, along with USEIP co-founder Holly Kasun and Colonel Shawn Smith (USAF, ret.), a USEIP volunteer and renowned elections expert, faced baseless and defamatory allegations of voter suppression, intimidation, and coercion in violation of the Voting Rights at of 1965 and the Ku Klux Klan Act of 1871. Holly Kasun was represented by Michael Wynne and Cameron Powell from GWA Law Firm, and Smith was also represented by counsel. Epp defended herself pro se.
The case was filed March 9, 2022, based on news reports with coordination out of Washington, D.C. The Plaintiffs in the case comprised the local chapters of three civil rights NGOs: the NAACP, League of Women Voters, and Mi Familia Vota. Plaintiffs were represented by more than a dozen attorneys from Free Speech for People and Lathrop GPM.
Plaintiffs rested their case after providing no evidence of voter intimidation, and the judge ruled in favor of the defendants' rule 52(c) motion for Judgement on Partial Findings (directed verdict). The defendants were awarded costs.
"This was a decisive and unequivocal victory for the constitutional rights of all Americans. The trial was scheduled for five days with a possible sixth, and was over in just three days through a directed verdict," Kasun told Colorado Free Press. "Fighting for the truth is always a worthwhile endeavor. It's a good day for the First Amendment."
