News broke Thursday that El Paso County was "refusing to certify" the November 4th election, in a post from Peter Bernegger on X:
I spoke with EPC Clerk and Recorder Steve Schleicher this morning and, upon investigation yesterday, he learned that Colorado Secretary of State Jena Griswold has known for years that the SOS website’s CSV file is inaccurate — badly misrepresenting election results across multiple Colorado counties.
This faulty data has reportedly been used for nearly a decade, leading to misleading election-night reporting and even triggering costly recount challenges when media numbers don’t match reality. Some clerks knew about the issue from past findings, but many didn’t. Meanwhile, the SOS continues relying on outdated SoeSoftware for election-night reporting.
If they know the data is wrong… why keep using it?
Colorado Free Press also spoke with other Colorado Clerks, who've raised concerns about the inaccuracy's impact on aggregate data and state-level metrics. Additionally, Bernegger's assertion that state level attorneys are involved in the matter is disputed; no clerks we spoke to were able to confirm the detail.
It’s hard not to wonder whether the SOS benefits from the chaos — candidates spending thousands on challenges because media outlets report one candidate far ahead based on a file they know is inaccurate.
The media is getting its numbers from this faulty report, and the SOS keeps publishing it anyway.
