The case is in the hands of the jury now, and they did not reach a verdict Friday after deliberating for a few hours. They will return Monday at 7aMT / 9aET.
The jury needs to determine if Mike Lindell had a “reckless disregard for the truth” in his defamation of Eric Coomer. The recklessness standard is how they are attempting to get to malice, which is a requirement since the judge already found that the statements are “defamation per se," or defamatory by themselves.
Central to Lindell’s defense against recklessness is that he had a reasonable basis for his beliefs, and that the “expert class” was blocking him from accessing the necessary resources to make change.
Halderman's testimony essentially confirmed that he was a blocker. According to his testimony, when he claims that Mike Lindell should have known that there was no fraud in the 2020 election, but he was still investigating in Antrim County. His report was issued in March, and recently produced drafts revealed at trial that Halderman changed his draft report after meeting with his Michigan State Government clients, removing concurrence with the ASOG report (which he was hired to dispute). Scandalous.
Let’s see what the jury does. And let’s end corrupt elections.
