On Friday morning, Governor Jared Polis and Secretary of State Jena Griswold announced that all the passwords in the state have been updated and the matter of the leaked passwords is resolved -- and the Libertarian Party of Colorado filed a lawsuit.
Today, Governor Jared Polis and Secretary of State Jena Griswold announced that the effort to update all passwords and verify the security of affected active voting systems in Colorado is complete. The joint effort concluded successfully Thursday evening.
“All of the passwords in affected counties have been changed. I want to thank Governor Polis for deploying extra state resources to help in this effort,” said Secretary of State Jena Griswold. “Colorado has countless layers of security to ensure our elections are free and fair, and every eligible voter should know their ballot will be counted as cast.”
“We appreciate the swift work to update these passwords. Every Coloradan can rest assured that their vote will be counted fairly and accurately. While the leaked passwords compromised just one of many layers of security that protect our election integrity in Colorado, we knew it was critical to take swift action and to work with Secretary Griswold and the county clerks to update the passwords immediately,” said Governor Jared Polis. “I want to especially thank the hardworking state employees and county clerk personnel who were part of this effort.”
This is a stunning declaration from the Executive Branch. The passwords were compromised for months, and there is no possibility that a proper forensic cyber investigation could have taken place to ensure Colorado voters that "every Coloradan can rest assured that their vote will be counted fairly and accurately."
How did Department employees ensure that social engineering during the primary election wasn't occurring? Did the investigation simply assume the initial posting was an accident? Were there any investigative steps to confirm it was an accident?
What about the log files? Did investigators audit the log files of all 600+ impacted devices in all 63 impacted counties? What about device actions that are not captured in the log files? Did investigators use the "Pause Election" feature on any of these devices to go in and change the password? According to former Elbert Clerk Dallas Schroeder, that action is not captured in the log files.
For days, we've been demanding a special counsel investigate this situation, and now others are joining our calls. George Brauchler, the former District Attorney in the 18th Judicial District and current candidate for District Attorney in the 23rd, is now calling for "independent investigators" outside the Attorney General's office due to overt conflicts of interest.
"Denver District Attorney Beth McCann and Colorado Attorney General Phil Weiser share jurisdiction on this matter. We have the power to force McCann to act. If “any person” files an affidavit “stating the name of any person who has violated any of the provisions of this code and stating the facts which constitute the alleged offense,” Colorado law compels the DA to “forthwith investigate, and, if reasonable grounds appear therefor, he shall prosecute the violator.” McCann is a Democrat. McCann’s successor, John Walsh is also a Democrat and a friend of Weiser’s. Walsh is on the ballot and potentially personally impacted by the SOS office misconduct. That likely is a conflict, too.
Polis — also a Democrat — could order Weiser to investigate and prosecute. Phil is a Democrat. So is Griswold. Phil wants to be governor. So does Griswold. Weiser (AG) represents Griswold, so there is an easy out for Weiser in claiming a conflict.
One other option exists. In 2008, then-Gov. Bill Ritter appointed Attorney General John Suthers to investigate and prosecute 4th Judicial District Attorney John Newsome, but Suthers had been Newsome’s boss — so there was a conflict. So, Suthers appointed two former DAs to investigate the case."
These hyper partisans cannot investigate themselves and then declare everything is fine. Public trust cannot tolerate such offensive pretense in the name of public trust.
While the Governor is claiming victory, the entirety of the government is now involved. From yesterday's press release:
"The state is leveraging resources from across various departments and coordinating with the Secretary of State and numerous local and federal partners. CDPS divisions, including the Division of Homeland Security and Emergency Management (DHSEM) and the Colorado State Patrol (CSP), and the Governor’s Office of Information Technology are collaborating closely with the Secretary of State’s Office, county clerks, and state, local, and federal law enforcement."
In addition to the stated actions of the Colorado GOP and the Trump Campaign, the Libertarian Party of Colorado confirmed on X Friday that they have filed legal action against the State.
