Tina Peters reportedly filed an urgent motion in her state appeal on Tuesday. Colorado Free Press reviewed an unstamped copy of the filing as well as five attached exhibits, including the pardon and two exhibits about the Whiskey Rebellion.
In the motion, Peters argues that the Colorado Court of Appeals lacks jurisdiction to adjudicate the appeal because a full and unconditional presidential pardon issued on December 5, 2025 extinguished all punishment and legal consequences arising from her election-related conduct. The state's position is that the President lacks the authority to pardon state crimes.
The motion contends that the Supremacy Clause bars state prosecution because the Peters' actions were undertaken to comply with federal election-record preservation requirements under 52 U.S.C. §20701, asserting that continuing enforcement of the conviction violates federal constitutional law and seeks an immediate determination of lack of jurisdiction and the release of Tina Peters from custody.
Peters' team expects to receive a stamped version of their pleading and all exhibits by Friday, and we will publish the full motion when we receive a court-stamped copy.
