Remanded: Trial Court Will Hear Case on Exorbitant Records Fees

The Colorado Court of Appeals reinstated a local man’s case against the state’s health department earlier this month, directing the trial court to determine if a $600 charge to obtain health records was reasonable.

The man is seeking records from paramedics regarding their administration of ketamine, and Colorado's second-highest court decided he deserves to be heard. 

Government agencies use exorbitant fees to chill records requests all the time, so it will be good to get clarity from the courts on what is lawful. This case will be one to watch.
