Rocky Mtn Gun Owners Files Updated Complaint in Assault Weapons Ban Case

Rocky Mountain Gun Owners, National Association For Gun Rights, Charles Bradley Walker, Bryan Lafonte, Gordon Madonna, and James Michael Jones have filed their first amendment complain in their challenge of the Assault Weapons Ban against several Colorado cities and counties: The Town of Superior, City of Louisville, Colorado, City of Boulder, Colorado, and Board of County Commissioners of Boulder County.

We just filed an amended complaint in our Colorado AWB/mag ban case. This wraps up a weird turn of events in this lawsuit where we survived an unexpected broadside over standing from the judge. Strap in, this one's a bit wild.

This lawsuit challenges gun and mag ban ordinances enacted by four Colorado local governments. These started as individual lawsuits where we won two back-to-back temporary restraining orders immediately after Bruen. 

When we combined the four cases into one, we also negotiated a voluntary stay of enforcement. That let us skip the interlocutory path and go straight to the merits process. We finished, filed summary judgment motions - and then things got interesting. 

In their response to our SJ motion, the cities - who officially have a Bloomberg lawyer on their team - briefly challenged our standing. The judge took that and ran with it, demanding a crazy level of proof of every single allegation. 

Does NAGR and RMGO have members in the four localities that actually want this lawsuit? Are they actually affected by the gun bans? She wanted their specific plans for what banned guns they wanted and when they wanted to buy them. 

These are honestly ridiculous questions to ask. Our very existence as a member-supported gun rights organization answers the question as to whether our members want us to destroy gun bans. But whatever. We know our members and we brought the proof. 

Judge Nina Wang also demanded these specifics from the individual plaintiffs helping us bring the lawsuit, and then she went through all the claims from all the plaintiffs against all the localities, threw some out, and kept others. 

By the time she finished we were all confused - including her, seemingly. She tried to make us simply drop some of the claims and plaintiffs, which we declined to do. So she then properly dismissed those claims & had us refile the complaint. 

Here's the complaint. Fortunately some form of the claims survive against all four localities, so we're back in business.

What’s next? Once the summary judgment motion is refiled, we are right back where we were for the longest time in this case - waiting for the judge to rule. It probably goes without saying that we expect this ruling to be 100% hostile when it comes. 

The good news is this: The judge tried her hardest to throw us out over standing and failed. And we are CLOSE to being able to take this to the 10th Circuit - our best shot of all the appellate courts at an actual AWB circuit split."
